Background - 30 Year Lease
Foreigners are prohibited from owning land in Thailand. However, foreigners can own the rights to a lease of 30 years with an option to renew two times for a total period of 90 years. This gives foreigners the rights to the leased land for basically their entire lifetime.
A 30 year lease can be registered at the Land Department similar to a mortgage or lien. Registering a 30 year lease gives public notice to any potential buyers of the land that it is encumbered by a 30 year lease. The actual lease agreement is not recorded, but the important terms of the lease are recorded. There is also a registration fee of 1.1% of the value of the lease.
